@disneyboy DreamWorks wouldn't have come after him if he did his own animation style and voicework. Mattel neither probably. It just would of been considered a fan film.
Fan creations are still unauthorized derivative works. There is no exception in the law for fan creations. It is soley up to the discretion of the rights holder whether to proverbially look the other way.
@jukka Why did NBC wait until the last second to threaten him if they knew about it the whole time that he was working on it?
- We do not have a documented timeline of when NBCUniversal became aware of it. So it is not necessarily the case that they "knew about it the whole time."
- The timing of issuing a cease and desist is the discretion of the rights holder. However, a more cynical interpretation would be that they waited to impose maximum hardship on the recipient.
@adam_prince-of-eternia I wonder how come they were allowed to include it in The Eternia Collection? Different distribution rights in Germany perhaps?

Go a little bit out of your depth. And when you don’t feel that your feet are quite touching the bottom, you’re just about in the right place to do something exciting."

It is possible that it was not specifically permitted, and that NBCUniversal is not aware of it.

Yea but they usually do look the other way. Going after fans is usually bad for business.

@durendal In a way when you think about it James was kind of an ex-employee. Maybe they could have done much worse to him.
🇺🇸 SNOUT SPOUT FOR PRESIDENT 🇺🇸
@durendal Didn't he work at the Dreamworks He-Man youtube channel producing content? You do that and I think you sign contracts and non disclosure agreements and stuff. You're no longer a fan but a former employee. I'm guessing there's probably more there for a legal department to go after.

That is not really the calculus. Rather, it is whether the average person would be confused about the authorship of the unauthorized work, or if the unauthorized work could be seen as competing with or supplanting an authorized work.
In any case, the first step in the process is discovery, and most unauthorized works do not gain enough notoriety to attract the attention of the rights holder, so they go effectively unnoticed.
Rights holders are not failing to enforce their exclusive rights due to goodwill public relations or corporate benevolence. It is because they do not view most unauthorized works as competition.

Licensing and distribution rights would matter in this case. Hence the Eternia Collection was only released in Germany. Making it into an International release would involve a lot more legal hurdles (as fans kept asking "how come its not released in North America, huh?")

That's a good question. All I know is that James mentioned that NBCUniversal were aware of it in the time leading up to the finished project. That's why it was such a shock that they sent their C&D at that last minute (when technically they could have maybe sent it already a year prior...)

Gotta disagree a little bro. Fan public relations sometimes is a factor too. I remember some higher profile battles went on years ago with Star Trek and Star Wars crowds where the studios retracted to appease the fan community

In the last five years, numerous Star Trek fan creators have received cease and desist orders, including Stage-9, despite the backlash.
I never knew the episode was hidden in there as an Easter Egg. I just finished watching it. Its really amazing what they managed to achieve.
The Eternia Collection is a really amazing set!
I am so happy I found this website! I own the Plaion box set and have been looking for the Faker episode online. I had no idea the Faker episode was on here the whole time! Could you please explain what disc it is on and how do I access it?
@samuel its on the last disc. As far I remember you go to one of the menu items, the last one maybe, and then go to the right and a little picture of Fakers head appears.

Fan project C&Ds... I don't wanna know in how many cases its because of a rampant running copyright lawer firm that needs to signal activity. A good copyright lawyer can be a good and helpful companion to a company. Best get them when they are still pups, they need to be properly trained and teached; its easier then when they are used to the smell of the company. And they always need to be held on a thight leash, ready to be punished if needed; else these wild beast run amok oblivious to the damage they cause to their owners.
Aaaanyway:
Insert "Disk 20 - Extras"
Go to the last tab called "Werbung & Promotion"
Press the -> arrow on your control and a little Faker bust appears. Press play.
@lurker-man I am so happy you did this with pictures. You are so amazing. I can't wait to watch it. Thank you thank you thank you!

You can purchase it when it is made available. This film was made by members of the community, who received a cease and desist from NBCUniversal for doing so. The least you could do is financially support their work, which would not exist without their efforts. Asking people to pirate it, and make it available to you for free, is effectively stealing from the very community in which you purport to be a part. It is completely shameful.
