I have the complete series from BCI and Mill Creek, plus I have it on Vudu streaming, so I don't really feel the need for an expensive import that might not play on my American blu-ray players. I would totally buy an American release on Blu-Ray if it were released though, even if just technically standard definition.
I hope Return of Faker gets completed (with me and other in it) soon as well as the documentary. It is taking way longer than I expected even with the covid issues.

I have reached out on the Kickerstarter page a couple of times over the last few years and the main guy in charge, Rob, basically said, we'll get to it when we get to it, which doesn't exactly inspire confidence. I might try again. I don't really do social media, so haven't contacted James directly. Maybe, if I knew his e-mail, I would.
I wonder what the legal situation around providing Return of Faker in an English box for an English Market would be? Would be awesome if everything could be retained!Â
This is a good question mate. James Eatock has no ownership of the characters and show he recreated and cannot profit from it. If the owners profit from it does James have to be paid for his work?

One thing to note. Mattel never came after James in regards to "The Return of Faker". That's all on NBCUniversal/Dreamworks.

It's just absurd overall. James is and was not making any profit from this fan project.
NBCUniversal was aware of it, as James did showcase it during a couple of years at Power-Con, as it all was taking shape. Then, when it was about to be finished and shown at Power-Con, NBC sent him a C&D at the last minute. Â

Fan creations are still unauthorized derivative works. There is no exception in the law for fan creations. It is soley up to the discretion of the rights holder whether to proverbially look the other way.

- We do not have a documented timeline of when NBCUniversal became aware of it. So it is not necessarily the case that they "knew about it the whole time."
- The timing of issuing a cease and desist is the discretion of the rights holder. However, a more cynical interpretation would be that they waited to impose maximum hardship on the recipient.

@durendal Didn't he work at the Dreamworks He-Man youtube channel producing content? You do that and I think you sign contracts and non disclosure agreements and stuff. You're no longer a fan but a former employee. I'm guessing there's probably more there for a legal department to go after.

That is not really the calculus. Rather, it is whether the average person would be confused about the authorship of the unauthorized work, or if the unauthorized work could be seen as competing with or supplanting an authorized work.
In any case, the first step in the process is discovery, and most unauthorized works do not gain enough notoriety to attract the attention of the rights holder, so they go effectively unnoticed.
Rights holders are not failing to enforce their exclusive rights due to goodwill public relations or corporate benevolence. It is because they do not view most unauthorized works as competition.

Licensing and distribution rights would matter in this case. Hence the Eternia Collection was only released in Germany. Making it into an International release would involve a lot more legal hurdles (as fans kept asking "how come its not released in North America, huh?")
